Welcome to Polo City, a community-driven
ride-hailing service operating in Manipur, India. By accessing or using the
Polo City mobile application ("App") or related services
(collectively, the "Services"), you agree to be bound by these Terms
and Conditions ("Terms"). These Terms govern the relationship between
you ("User," "Passenger," or "PILOT") and GlazingHills
Pvt. Ltd. ("Polo City," "we," "us," or
"our"), the operator of the App. If you do not agree with these
Terms, please do not use the Services.
1. Definitions
·
App: The Polo City mobile application available on iOS and Android
platforms.
·
Services: Ride-hailing, payment processing, and related features
provided through the App.
·
Passenger: A User who books a ride through the App.
·
PILOT: A User who provides transportation services to Passengers via
the App.
·
Ride: A transportation service booked and completed through the App.
·
Manipur: The geographical region of Manipur, India, where the Services
are provided.
2. Eligibility
To use the Services, you must:

Be at least 18 years
old or have parental consent if under 18 (for Passengers).
·
Hold a valid driver’s
license and necessary permits if registering as a Driver, in compliance with
the Motor Vehicles Act, 1988, and Manipur state regulations.
·
Have a compatible
mobile device with internet access.
·
Provide accurate and
complete information during registration.
3. Account Registration
·
You must create an
account to use the Services. You agree to provide accurate, current, and
complete information during registration.
·
You are responsible
for maintaining the confidentiality of your account credentials and for all
activities under your account.
·
Notify us immediately
at support@polocity.in if you suspect unauthorized use of your
account.
·
We reserve the right
to suspend or terminate accounts for violations of these Terms or applicable
laws.
4. Use of Services
4.1 Passenger Responsibilities
·
Book rides only for
lawful purposes and provide accurate pickup and drop-off details.
·
Pay all applicable
fares, taxes, and fees as displayed in the App.
·
Treat PILOT and their
vehicles with respect. Do not engage in behavior that is abusive,
discriminatory, or unsafe.
·
Comply with safety
instructions, including wearing seat belts, as required under the Motor
Vehicles Act, 1988.
·
Do not carry
prohibited items, including weapons, flammable materials, or illegal
substances.
4.2 PILOT Responsibilities
·
Maintain a valid
driver’s license, vehicle registration, insurance, and any permits required by
Manipur Govt.
·
Ensure your vehicle is
in good condition, complies with safety standards, and is registered for
commercial use.
·
Accept ride requests
promptly and provide safe, reliable transportation.
·
Follow the routes
suggested by the App unless otherwise agreed with the Passenger.
·
Do not discriminate
against Passengers based on caste, religion, gender, or any other protected
characteristic, as per the Constitution of India and Manipur
laws.
4.3 Prohibited Conduct
You agree not to:

Use the Services for
illegal activities, including transporting contraband or engaging in human
trafficking.
·
Misrepresent your
identity or provide false information.
·
Interfere with the
App’s functionality, including hacking or introducing malware.
·
Harass, threaten, or
harm other Users.
·
Use the App while
under the influence of alcohol or drugs.
5. Fares and Payments
·
Fare Structure: Fares are calculated based on distance, time, and ride type
(e.g., Comfort, Economy,Sharing). Additional charges, such as tolls or taxes,
may apply.
·
Payment
Methods: Passengers may pay via UPI, digital wallets,
or cash, as available in the App. All digital payments are processed through
secure third-party gateways.
·
PILOT Earnings: Pilots receive payments for completed rides, less a commission
as agreed during onboarding. Payments are disbursed weekly via bank transfer or
UPI.
·
Disputes: Any fare disputes must be reported within 48 hours of the ride
to support@polocity.in. We will investigate and resolve disputes
fairly.
·
Taxes: Users are responsible for any applicable taxes, including GST,
as per Indian tax laws.
6. Safety and Emergency Features
·
Safety Tools: The App includes an SOS button, ride-sharing with trusted
contacts, and real-time tracking for Passenger safety.
·
PILOT
Verification: Pilots undergo
background checks and vehicle inspections in compliance with Manipur transport
regulations.
·
Emergency
Contact: In case of an emergency, contact local
authorities (e.g., Manipur Police at 100) or use the App’s SOS feature.
·
POLO CITY is not
liable for incidents arising from User misconduct or external factors beyond
our control.
7. Cancellations and Refunds
·
Passenger
Cancellations: Passengers may
cancel a ride before the PILOT arrives without charge. A cancellation fee may
apply if canceled after the PILOT has started the trip.
·
PILOT
Cancellations: Pilots who cancel
rides excessively may face account suspension.
·
Refunds: Refund requests for overcharges or incomplete rides must be
submitted within 7 days. Refunds are processed within 10 business days, subject
to investigation.
8. Intellectual Property
·
All content,
trademarks, and software in the App are owned by or licensed to Polo City. You
may not copy, modify, or distribute any part of the App without our written
consent.
·
Users grant Polo City
a non-exclusive, royalty-free license to use feedback or suggestions provided
for improving the Services.
9. Privacy
·
Your personal data is
collected, stored, and processed in accordance with our Privacy Policy (available
at www.polocity.in/privacy) and the Information Technology Act, 2000.
·
We use your data to
provide Services, process payments, and ensure safety. We do not share your
data with third parties except as required by law or for service provision
(e.g., payment processors).
10. Limitation of Liability
·
Polo City provides a
platform to connect Passengers and Pilots but is not responsible for the
conduct of Users.
·
To the extent
permitted by law, Polo City is not liable for any direct, indirect, or
consequential damages arising from the use of the Services, including
accidents, delays, or loss of property.
·
Our total liability,
if any, shall not exceed the fare paid for the Ride in question.
11. Indemnity
You agree to indemnify and hold Polo City harmless from any
claims, losses, or damages arising from your breach of these Terms, misuse of
the Services, or violation of applicable laws.
12. Termination
·
We may suspend or
terminate your account for violations of these Terms, fraudulent activity, or
at our discretion with notice.
·
You may deactivate
your account by contacting support@polocity.in.
13. Governing Law and Dispute Resolution
·
These Terms are
governed by the laws of India and the state of Manipur.
·
Any disputes shall be
resolved through amicable negotiation. If unresolved, disputes will be subject
to the exclusive jurisdiction of courts in Imphal, Manipur.
·
For consumer disputes,
you may approach the Manipur State Consumer Disputes Redressal
Commission as per the Consumer Protection Act, 2019.
14. Modifications to Terms
·
We may update these
Terms from time to time. Changes will be notified via the App or email and take
effect upon posting.
·
Continued use of the
Services after changes constitutes acceptance of the updated Terms.
15. Local Considerations for Manipur
·
Cultural
Sensitivity: Users must respect
the diverse cultural, ethnic, and linguistic heritage of Manipur.
Discriminatory behavior based on tribe, community, or language is strictly
prohibited.
·
Connectivity: In areas with limited internet access, such as rural Manipur,
some App features (e.g., real-time tracking) may be affected. Users are advised
to plan rides accordingly.
·
Local
Regulations: Pilots must comply
with Manipur’s transport regulations, including permits for commercial vehicles
and adherence to curfews or restrictions imposed by local authorities.

17. Miscellaneous
·
Force Majeure: Polo City is not liable for delays or failures due to events
beyond our control, such as natural disasters, bandhs, or government
restrictions in Manipur.
·
Severability: If any provision of these Terms is found invalid, the
remaining provisions remain enforceable.
·
Language: These Terms are provided in English. Translations, if
available, are for convenience only.
